Provision and Use of Work Equipment Regulations 1998

Q. What is PUWER, and why is it important in my workplace?
A. PUWER ensures all work equipment is safe, properly maintained, and suitable for its purpose. In a manufacturing environment, this means reducing the risk of accidents with forklifts, cranes, MEWPs, and abrasive wheels, protecting both staff and operations.


 Q. What training do I need to provide my staff under PUWER?
A. Under PUWER Regulation 9, employers must ensure that all staff receive adequate information, instruction, and training to use work equipment safely. In a manufacturing environment, this means operators of forklifts, cranes, MEWPs, and abrasive wheels must be trained not only in operation but also in recognising hazards, reporting defects, and following safe working procedures.


Q. Which equipment does PUWER cover?
A. PUWER applies to any equipment that could cause harm if used incorrectly or poorly maintained. In engineering, this includes lifting equipment, powered machines, MEWPs, and tools with abrasive surfaces, among others.


Q. What are my responsibilities as an employer?
A. You must make sure equipment is fit for purpose, maintained, inspected, and only operated by trained staff. Records of training, inspections, and repairs should be kept to demonstrate compliance.


Q. How often should equipment be inspected?
A. Inspection frequency depends on the type of equipment, its usage, and manufacturer guidance. For example, lifting equipment and MEWPs require routine checks before use and periodic detailed inspections, while abrasive wheels should be checked each time they’re mounted.


Q. What training is required for operators?
A. Operators must be competent and trained to safely use equipment. This includes understanding hazards, correct operation, and maintenance routines. Documented training is crucial for both safety and compliance.


Q. How should maintenance and repairs be managed?
A. Equipment should be serviced according to manufacturer guidance by competent personnel. Any defects must be addressed immediately to prevent accidents. Keeping detailed maintenance records is essential, especially for high-risk machinery like cranes and MEWPs.


Q. What should I do if equipment is unsafe?
A. Immediately remove it from use and investigate the cause. Do not allow staff to operate defective forklifts, cranes, MEWPs, or abrasive wheels until they are repaired and verified as safe.


Q. How does PUWER relate to other regulations?
A. PUWER works alongside LOLER for lifting equipment and general health and safety law. Ensuring compliance with both protects staff and demonstrates due diligence during inspections or audits.


Q. Does PUWER apply to second-hand or hired equipment?
A. Yes. All equipment used at work must meet PUWER standards, whether it is owned, leased, or rented. Always check service records and suitability for the intended tasks before use.


Q. How can I demonstrate compliance?
A. Maintain clear records of inspections, maintenance, and operator training. This shows regulators and insurers that equipment is safe and that staff are competent to use it.


Q. Can I allow new staff to use equipment straight away?
A. No. Staff must be trained and competent before operating any equipment. Even experienced workers need familiarisation with your specific machines, whether it’s a forklift, crane, MEWP, or abrasive wheel.
